General Terms and Conditions
Last updated: 3 August 2026
1. Provider and contact details
These General Terms and Conditions govern purchases made through:
Sillage Dépôt
Operated by: Damiana Silletti
Legal form: SILLAGE DÉPÔT by Damiana Silletti
Registered address: Muristrasse 8, 5618, Bettwil
UID: CHE-416.056.586
VAT number: CHE-xxx.xxx.xxx MWST
Email: boutique@sillagedepot.ch
Website: www.sillagedepot.ch
Hereafter referred to as “Sillage Dépôt,” “we,” “us” or “our.”
2. Scope
These General Terms and Conditions apply to all orders placed through www.sillagedepot.ch.
They apply primarily to purchases by consumers for private use. Orders made for resale, commercial distribution or other business purposes require our prior written approval and may be subject to separate conditions.
By submitting an order, the customer confirms that they have read and accepted:
- these General Terms and Conditions;
- the Returns & Refunds Policy;
- the Shipping & Delivery Policy; and
- the Privacy Policy.
The Returns & Refunds Policy and Shipping & Delivery Policy form an integral part of these General Terms and Conditions.
Any conflicting customer terms are excluded unless Sillage Dépôt expressly accepts them in writing.
3. Customer eligibility
Customers must have the legal capacity necessary to enter into a binding purchase contract.
Customers under the age of 18 may place an order only with the consent of a parent or legal representative where such consent is required by law.
The customer must provide complete, accurate and current information when placing an order.
Sillage Dépôt may refuse or cancel an order where there are reasonable grounds to believe that:
- the customer cannot legally enter into the transaction;
- the information supplied is false or incomplete;
- the order is fraudulent or abusive;
- the products are intended for unauthorised resale; or
- completing the order would violate a legal or regulatory obligation.
4. Products and product information
Sillage Dépôt sells original products sourced from authorised brands, distributors or other legitimate supply channels.
We take reasonable care to ensure that product descriptions, photographs, ingredients, sizes, concentrations, prices and availability information are accurate.
However:
- colours may appear differently depending on the customer’s screen;
- packaging, bottles, labels or presentation boxes may be changed by the fragrance house;
- product photographs are illustrative;
- natural ingredients may produce minor variations between batches;
- fragrance colour may change gradually without affecting product quality;
- fragrance houses may reformulate products; and
- minor artisanal variations may occur in handmade products or packaging.
The product supplied may therefore differ slightly from photographs or earlier versions without being defective, provided that its essential characteristics remain materially consistent with the description.
The customer must review the product description and relevant product information before ordering.
5. Fragrance perception
Fragrance perception is subjective and may vary according to skin chemistry, application, temperature, humidity, storage conditions and individual sensitivity.
Sillage Dépôt does not guarantee that:
- a customer will personally like a fragrance;
- a fragrance will smell identical on different people;
- its projection or longevity will meet a particular expectation;
- a full bottle will appear identical to an older sample or batch; or
- a fragrance will perform in the same way under all conditions.
Personal dissatisfaction with a fragrance’s scent, development, projection or longevity does not constitute a product defect.
Customers who are unfamiliar with a fragrance should consider purchasing or obtaining an official sample or discovery set where available before ordering a full-sized bottle.
6. Availability
Products are subject to availability.
Adding a product to the shopping cart does not reserve it. A product may become unavailable before the order is accepted.
Inventory errors may occasionally occur. If an ordered product is unavailable, Sillage Dépôt may:
- cancel the affected item;
- contact the customer to offer an alternative;
- dispatch the available items separately; or
- cancel the entire order where partial fulfilment would be unreasonable.
An alternative product will be supplied only with the customer’s agreement.
Amounts already paid for unavailable or cancelled products will be refunded through the original payment method wherever reasonably possible.
7. Prices
All prices are stated in Swiss francs, CHF.
Where Sillage Dépôt is registered for Swiss VAT, prices displayed to consumers include the applicable Swiss VAT unless expressly stated otherwise.
Delivery charges and optional services are shown separately before the customer submits the order.
The total amount payable is displayed during checkout.
Prices may change at any time. The price applicable to an accepted order is the price displayed when the customer submits that order, subject to correction of obvious errors.
8. Obvious pricing and information errors
Sillage Dépôt is not required to fulfil an order at a price that is clearly incorrect due to an obvious typographical, technical or system error.
Examples may include:
- a decimal-point error;
- an obviously unrealistic price;
- duplicate or conflicting prices;
- an incorrect discount calculation; or
- a product description that clearly refers to a different item.
Where such an error occurs, Sillage Dépôt may cancel the order before dispatch and refund any amount already paid.
Where the error is not obvious or the order has already been completed, the matter will be handled in accordance with applicable Swiss law.
9. Ordering process
The presentation of products on the website generally constitutes an invitation for customers to submit an order and not a binding offer by Sillage Dépôt.
The customer submits a binding order by:
- selecting the products;
- entering the requested customer and delivery information;
- choosing the delivery and payment method;
- reviewing the order summary and total price;
- accepting the applicable contractual terms; and
- activating the button confirming the order and payment obligation.
Before submitting the order, the customer can review and correct the information entered.
10. Conclusion of the contract
An automatically generated order acknowledgement confirms that the order has been received. It does not by itself constitute acceptance of the order unless expressly stated otherwise.
The purchase contract is concluded when Sillage Dépôt:
- sends the customer a dispatch confirmation; or
- otherwise expressly confirms acceptance of the order.
For orders containing multiple products, acceptance may apply only to the products identified in the dispatch or acceptance confirmation.
Sillage Dépôt reserves the right to reject an order before acceptance, particularly in the event of:
- unavailability;
- an obvious price or product-information error;
- unsuccessful payment;
- suspected fraud or misuse;
- delivery restrictions;
- unusually large quantities;
- suspected unauthorised resale; or
- legal or regulatory restrictions.
If an order is rejected after payment has been collected, the corresponding amount will be refunded.
11. Payment
The payment methods available are displayed during checkout and may include payment cards, TWINT, accelerated checkout services or other payment providers.
Payment is due when the order is submitted unless another arrangement is expressly displayed and accepted.
Payments may be processed by third-party payment providers. The customer may also be subject to the provider’s terms and privacy information.
The customer must ensure that:
- the payment information is correct;
- they are authorised to use the selected payment method; and
- sufficient funds or credit are available.
Sillage Dépôt may delay or refuse acceptance of an order until payment has been successfully authorised or received.
Sillage Dépôt is not responsible for charges imposed independently by the customer’s bank, card issuer or payment provider.
12. Fraud prevention and order verification
Sillage Dépôt may carry out reasonable checks to prevent fraud, payment abuse and unauthorised transactions.
We may ask the customer to confirm information necessary to verify:
- their identity;
- the payment method;
- the billing or delivery address; or
- the legitimacy of the transaction.
Dispatch may be suspended while a reasonable verification is completed.
Sillage Dépôt will not request unnecessary sensitive payment information by ordinary email.
13. Delivery area
Sillage Dépôt currently delivers only to valid delivery addresses within Switzerland.
Orders for delivery outside Switzerland are not accepted unless Sillage Dépôt expressly agrees otherwise in writing.
Restrictions may apply to post office boxes, parcel terminals, collection points, remote addresses or locations not accepted by the selected carrier.
14. Dispatch
For available products, successfully paid orders are handed over to Swiss Post no later than the end of the next business day after acceptance of the order.
Business days are Monday to Friday, excluding public holidays applicable at the Sillage Dépôt dispatch location.
The dispatch commitment applies only where:
- payment has been authorised or received;
- the product is available;
- the address is complete and valid;
- no customer verification is required; and
- no different dispatch period is displayed for the product.
Pre-orders, back-orders, special orders and products with expressly stated longer processing periods are excluded from the next-business-day dispatch commitment.
15. Delivery service and estimated delivery period
Orders are normally sent using Swiss Post PostPac Priority or an equivalent tracked priority service.
Swiss Post Priority parcels are normally scheduled for delivery on the next working day after dispatch. This is a carrier service standard and not an absolute delivery guarantee by Sillage Dépôt.
Under normal circumstances, an available order should therefore arrive approximately two to three business days after acceptance:
- dispatch by Sillage Dépôt on the next business day; and
- expected delivery by Swiss Post on the following working day.
Delivery dates and times are estimates unless Sillage Dépôt expressly agrees to a binding delivery date in writing.
Saturday delivery is not included unless expressly shown during checkout or confirmed separately.
Detailed delivery conditions are contained in the Shipping & Delivery Policy.
16. Delivery delays
Sillage Dépôt is responsible for meeting its stated dispatch commitment but cannot control Swiss Post’s performance after a parcel has been handed over.
Delivery may be delayed by circumstances including:
- carrier disruption;
- exceptional parcel volumes;
- adverse weather;
- public holidays;
- inaccessible premises;
- incorrect address information;
- recipient absence;
- customer-requested redirection;
- security checks; or
- events outside our reasonable control.
A minor carrier delay does not automatically entitle the customer to cancel the contract or claim compensation.
Where Swiss law requires the customer to set an additional reasonable period for performance before cancelling due to delay, the customer must provide that period.
Mandatory statutory rights remain unaffected.
17. Delivery address and customer responsibility
The customer is responsible for providing a complete and accurate delivery address.
Sillage Dépôt is not responsible for a delay, failed delivery or additional cost caused by incorrect or incomplete information supplied by the customer.
Customers must notify Sillage Dépôt immediately if an address correction is required. An address cannot necessarily be changed once preparation or dispatch has begun.
Additional shipping, return and redelivery costs attributable to an incorrect address, failed collection or unjustified refusal may be charged to the customer.
18. Tracking and delivery instructions
Where available, the customer will receive tracking information after dispatch.
The customer is responsible for monitoring the shipment and complying with collection deadlines and delivery notices.
Delivery instructions issued directly by the customer to Swiss Post—including authorisation to leave the parcel at a designated place, deliver it to a neighbour or redirect it—are outside Sillage Dépôt’s control.
Where the customer authorises unattended deposit, delivery recorded by Swiss Post at the authorised location will normally be treated as completed.
The customer should select a secure delivery location that protects perfume products from theft, rain, direct sunlight, excessive heat and freezing temperatures.
19. Transfer of transport risk
For consumer orders, Sillage Dépôt bears the risk of accidental loss or damage during the ordinary transport arranged by Sillage Dépôt until the parcel is validly delivered to the customer or to a recipient or location authorised by the customer.
Once valid delivery has occurred, the customer bears the risk of subsequent loss, theft, damage, heat exposure, freezing or improper storage.
Where the customer independently arranges a carrier or delivery method not offered by Sillage Dépôt, the applicable risk allocation will be determined under Swiss law.
20. Uncollected and refused parcels
A parcel that is refused or not collected is not automatically treated as an accepted cancellation or return.
Where a parcel is returned because:
- the customer failed to collect it;
- the address was incorrect or incomplete;
- access was not possible;
- the customer unjustifiably refused delivery; or
- the customer failed to comply with carrier instructions,
Sillage Dépôt may deduct the actual original shipping, return transport and reasonable handling costs from any refund.
A refund will be considered only after the parcel has been safely returned and inspected.
21. Voluntary 14-day returns
Swiss law does not generally provide a cooling-off right for ordinary online purchases. Nevertheless, Sillage Dépôt voluntarily accepts eligible change-of-mind returns requested within 14 calendar days after delivery.
A change-of-mind return is accepted only where the product:
- is unused and unopened;
- retains its complete original cellophane, seals and protective wrapping;
- is complete and undamaged;
- remains in resaleable condition;
- is accompanied by proof of purchase; and
- has been authorised for return in advance.
Opening or damaging the cellophane, protective wrapping, bottle seal or security label makes a perfume ineligible for a change-of-mind return.
The detailed procedure, exclusions, return costs and refund conditions are contained in the Returns & Refunds Policy.
22. Products excluded from voluntary returns
Unless defective, damaged during delivery or incorrectly supplied, voluntary returns are not accepted for:
- opened or tested perfumes;
- products with broken or removed seals;
- samples and discovery sets;
- personalised or engraved products;
- specially ordered products;
- gift cards;
- final-sale products;
- complimentary samples and promotional gifts; or
- products damaged through improper use, handling or storage.
A customer’s dislike of a fragrance does not make an opened perfume eligible for return.
23. Return transport of perfume
Perfume contains alcohol and may be subject to carrier restrictions applicable to flammable goods.
Customers must not return a perfume before receiving return instructions from Sillage Dépôt.
The customer must use the approved or recommended return method and comply with applicable packaging and transport requirements.
For voluntary change-of-mind returns, return shipping costs and transport risk are borne by the customer.
For confirmed defective, damaged or incorrectly supplied products, Sillage Dépôt will arrange or reimburse an appropriate return method.
24. Inspection and refunds
Returned products are inspected before a refund is approved.
Sillage Dépôt may refuse a voluntary return where the product:
- has been opened or tested;
- is incomplete;
- has damaged packaging or seals;
- has been improperly transported;
- cannot be resold as new; or
- was returned outside the authorised procedure.
Approved refunds are normally processed within 10 business days after receipt and inspection, using the original payment method wherever possible.
Bank or payment-provider processing periods are outside Sillage Dépôt’s control.
For voluntary returns, original delivery charges are not refunded unless expressly stated otherwise or required by mandatory law.
25. Inspection after delivery
Customers should inspect the parcel and products promptly after delivery.
Visible shipping damage, leakage, breakage, missing products or incorrect products should be reported as soon as possible, preferably within 48 hours after delivery.
Customers should retain the shipping box, shipping label, internal packaging and affected products and provide clear photographs.
The requested 48-hour reporting period helps Sillage Dépôt investigate transport damage. It does not eliminate statutory rights concerning defects that could not reasonably have been discovered within that period.
26. Defective products and statutory warranty
Sillage Dépôt is responsible for defects in accordance with the applicable provisions of the Swiss Code of Obligations, particularly Articles 197 et seq.
A product may be defective where, at the relevant time, it lacks an expressly promised quality or a quality reasonably expected for its ordinary use.
The statutory limitation period for claims concerning defects is generally two years from delivery, subject to applicable Swiss law.
Customers must notify Sillage Dépôt of a defect promptly after discovering it and provide sufficient information to assess the claim.
The customer must not continue using a product where doing so could worsen the defect, create a safety concern or make assessment impossible.
27. Remedies for defective products
Where a product is confirmed to be defective, Sillage Dépôt may initially offer an appropriate remedy, depending on the circumstances, proportionality and product availability, including:
- replacement with the same product;
- an equivalent product with the customer’s agreement;
- an appropriate price reduction; or
- cancellation of the affected purchase and refund.
Nothing in these Terms removes remedies that the customer is entitled to exercise under mandatory Swiss law.
Replacement may be impossible where a product is discontinued, limited edition, sold out or no longer available.
Normal variations, subjective fragrance perception and damage occurring after valid delivery through incorrect handling or storage do not constitute warranty defects.
28. Manufacturer guarantees
A fragrance house or manufacturer may provide an additional commercial guarantee.
Any such guarantee is separate from Sillage Dépôt’s statutory obligations and is governed by the conditions stated by the manufacturer.
A manufacturer guarantee does not restrict the customer’s rights against Sillage Dépôt under applicable law.
29. Proper storage and use
Perfumes must be stored and used in accordance with the product instructions and with reasonable care.
Customers should generally:
- keep perfumes away from flames and ignition sources;
- avoid excessive heat and freezing;
- protect bottles from prolonged direct sunlight;
- keep products securely closed;
- avoid ingestion and contact with eyes;
- keep products out of reach of children; and
- discontinue use if an unexpected adverse reaction occurs.
Sillage Dépôt is not responsible for deterioration or damage caused after delivery by incorrect storage, misuse, accidental damage or failure to follow product instructions.
This provision does not exclude liability for a defect that already existed when risk transferred to the customer.
30. Allergies and sensitivities
Perfumes and cosmetic products may contain allergens or substances capable of causing sensitivity in some individuals.
Ingredient information is provided on the product, packaging or website where available. The information accompanying the physical product takes precedence where there is a legitimate packaging update.
Customers with known allergies, sensitivities or medical concerns must review the ingredients before use and obtain appropriate professional advice where necessary.
Sillage Dépôt does not provide medical advice.
A reaction caused solely by an individual sensitivity does not automatically establish that a product is defective. This does not affect rights relating to an incorrectly labelled, contaminated or otherwise legally defective product.
31. Promotions and discount codes
Promotions, discount codes and special offers are subject to their stated conditions.
Unless expressly stated otherwise:
- codes cannot be exchanged for cash;
- codes cannot be applied retrospectively;
- only one code may be used per order;
- discounts do not apply to delivery charges;
- excluded products or brands remain excluded;
- codes may have an expiry date; and
- promotions apply only while stocks last.
Sillage Dépôt may cancel or correct a promotion affected by an obvious technical error or misuse.
Where part of a promotional order is returned, the discount and any qualifying threshold may be recalculated based on the retained products.
Complimentary gifts linked to a returned purchase must also be returned unopened. Otherwise, their stated value may be deducted from the refund where legally permissible.
32. Gift cards
Where Sillage Dépôt offers gift cards, the specific terms displayed when they are purchased form part of these Terms.
Unless otherwise stated:
- gift cards may be used only at www.sillagedepot.ch;
- they cannot be redeemed for cash;
- they cannot be used to purchase another gift card;
- lost or stolen codes may not be replaced where they have already been used; and
- any validity period will be displayed before purchase.
Mandatory legal rights remain unaffected.
33. Quantity restrictions and resale
Sillage Dépôt is intended as a selective retail channel for end customers.
We may limit quantities per customer, household, account, payment method or delivery address.
Orders may be rejected or cancelled before acceptance where there are reasonable indications of:
- unauthorised commercial resale;
- bulk purchasing inconsistent with private use;
- circumvention of quantity restrictions;
- automated purchasing;
- fraud; or
- conduct harmful to Sillage Dépôt or its brand partners.
Products purchased from Sillage Dépôt may not be represented as having been supplied through an authorised wholesale or distribution relationship unless such a relationship has been agreed in writing.
34. Customer accounts
Customers may be able to create an account.
The customer is responsible for:
- maintaining the confidentiality of login credentials;
- providing accurate account information;
- preventing unauthorised access; and
- notifying Sillage Dépôt promptly of suspected misuse.
Sillage Dépôt may suspend or close an account where reasonably necessary because of fraud, security risks, unlawful activity or serious breach of these Terms.
Closing an account does not remove obligations arising from orders already placed.
35. Website availability
Sillage Dépôt aims to maintain reliable website access but does not guarantee uninterrupted or error-free operation.
The website may be temporarily unavailable because of:
- maintenance;
- technical faults;
- security measures;
- third-party platform disruption; or
- circumstances beyond our reasonable control.
Sillage Dépôt may update, suspend or modify website functions where reasonably necessary.
36. Intellectual property
The website and its content—including the Sillage Dépôt name, visual identity, photographs, editorial text, graphics, layouts and original materials—are protected by applicable intellectual-property laws.
Brand names, product images and trademarks belonging to fragrance houses or other third parties remain the property of their respective owners.
Customers may use the website for personal, non-commercial shopping purposes.
Without prior written permission, users may not:
- copy or republish substantial website content;
- use images or text commercially;
- scrape product data;
- reproduce the website design;
- remove rights notices; or
- imply an affiliation with Sillage Dépôt.
37. Reviews and customer content
Where customers are permitted to submit reviews, comments, images or other content, they must ensure that the content:
- is truthful and based on genuine experience;
- does not infringe third-party rights;
- is not defamatory, unlawful or misleading;
- does not contain malicious code or unsolicited advertising; and
- does not disclose personal information without authorisation.
Sillage Dépôt may moderate or remove content where reasonably necessary, but is not required to publish every submission.
The customer grants Sillage Dépôt a non-exclusive right to display and reproduce submitted content for operating and promoting the website, subject to applicable data-protection and intellectual-property law.
38. Privacy and data protection
Sillage Dépôt processes personal data in accordance with applicable Swiss data-protection law and the Sillage Dépôt Privacy Policy.
Personal data may be processed for purposes including:
- order administration;
- payment processing;
- fraud prevention;
- delivery;
- customer service;
- fulfilment of legal obligations; and
- marketing where permitted.
The Privacy Policy explains the relevant processing, recipients, retention practices and customer rights.
Acceptance of these General Terms and Conditions does not replace any separate consent required by data-protection or electronic-marketing law.
39. Liability
Sillage Dépôt is liable in accordance with applicable Swiss law.
To the extent legally permitted, Sillage Dépôt is not liable for losses caused by:
- incorrect information supplied by the customer;
- customer-authorised carrier instructions;
- improper storage or use after delivery;
- unauthorised alteration of a product;
- website interruption outside our reasonable control;
- third-party services outside our control; or
- force majeure.
To the extent legally permitted, liability for indirect or consequential commercial losses is excluded where the purchase was made for business or resale purposes.
Nothing in these Terms excludes or limits liability for:
- wilful misconduct;
- gross negligence;
- death or personal injury where liability cannot legally be excluded;
- fraudulent conduct; or
- any other liability that cannot be excluded under mandatory law.
40. Force majeure
Sillage Dépôt is not liable for delay or non-performance caused by events outside its reasonable control, including:
- natural disasters;
- severe weather;
- fire;
- epidemic or pandemic measures;
- war or civil disturbance;
- government restrictions;
- industrial action;
- transport interruption;
- energy or telecommunications failure;
- cyber incidents;
- carrier disruption; or
- major supplier failure.
Sillage Dépôt will take reasonable steps to minimise the effect of such an event.
Where performance remains impossible for an extended period, either party may exercise the rights available under applicable Swiss law.
41. Communications
Sillage Dépôt may communicate with customers electronically using the email address or contact details supplied with the order.
The customer is responsible for ensuring that these details remain correct and that Sillage Dépôt communications are not blocked by spam filters.
Operational communications relating to an order are not marketing messages and may be sent where necessary to perform the contract.
42. Amendments to these Terms
Sillage Dépôt may amend these General Terms and Conditions prospectively where necessary because of:
- changes in law;
- changes to the business or services;
- changes to payment or delivery arrangements;
- security requirements; or
- clarification of existing provisions.
The version accepted when an order is submitted applies to that order.
Material changes will not retroactively alter an existing purchase contract without the customer’s agreement, unless required by mandatory law.
43. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain effective.
The invalid provision will be replaced or interpreted, to the extent legally possible, in a manner that most closely reflects its lawful commercial purpose.
44. No waiver
A failure or delay by Sillage Dépôt in exercising a contractual or legal right does not constitute a waiver of that right.
A waiver relating to one event does not constitute a waiver relating to a later event.
45. Applicable law
These General Terms and Conditions and all purchase contracts concluded through www.sillagedepot.ch are governed by substantive Swiss law, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods, to the extent that such exclusion is legally permissible.
Mandatory consumer-protection provisions applicable to the customer remain unaffected.
46. Jurisdiction
The competent courts are determined according to applicable Swiss law.
For customers acting as consumers, nothing in these Terms restricts a mandatory place of jurisdiction available at the customer’s domicile or any other jurisdiction that cannot validly be excluded by agreement.
For business customers, and where legally permissible, the exclusive place of jurisdiction is Aarau Canton Argovia.
47. Contact and complaints
Questions, complaints, delivery issues, return requests and defect notifications should be sent to:
